Who are we
Legally, we are known as Interactive Junction Holdings (Pty) Ltd, but all of the brands listed below come under our corporate umbrella in one way or another:
When we refer to ourselves in this document we mean the legal entity Interactive Junction Holdings (Pty) Ltd, registration number 1996/015192/07, of Times Media House, 4 Biermann Avenue, Rosebank, Gauteng, 2196, South Africa and any division or subsidiary of that entity.
For those of you who will be signing up for one of the services we offer for a fee, please pay particular attention to the sections headed 'Paying for a Premium Service', 'Cancelling or suspending a Premium Service', and 'Additional terms applicable to Recruiters'.
Restrictions on website usage
You are prohibited from:
- using any robot, spider, other automatic device or manual process to monitor or copy any part of our websites;
- using any robot, spider or automated devices to generate automated postings or spam;
- using any device, software or routine or the like to interfere or attempt to interfere with the proper working of any of our websites;
- taking any action that imposes an unreasonable or disproportionately large load on our websites' infrastructure;
- accessing our websites by any means other than through the interface that is provided by us or attempting to access our websites without first logging in through the log-in page;
- copying, reproducing, altering, modifying, creating derivative works, or publicly displaying any content from our websites without our prior written permission;
- reverse assembling or otherwise attempting to discover any source code relating to our websites;
- attempting to access any area of our website to which access is not authorized.
You are prohibited from violating or attempting to violate the security of our websites. Specifically you are prohibited from:
- accessing data not intended for general use or logging into a server or account which you are not authorized to access;
- attempting to probe, scan or test the vulnerability of our systems or networks or to breach security or authentication measures without proper authorization;
- attempting to interfere with our service to any user, host or network, including, without limitation, via means of submitting a virus to the website, overloading, "flooding", "spamming", "mail bombing" or "crashing";
- sending or posting unsolicited email, including promotions; advertising content or advertising of products or services;
- forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting;
- deleting or revising any material posted by any other person or entity.
You are warned that violations of our website, systems and network security may result in civil or criminal liability. We will investigate potential violations and will involve law enforcement authorities in prosecuting users who are involved in such violations.
Use of our forums
Please feel free to take part in discussions by posting comments on any of the discussion forums available on our websites.
However, please do not use our forums:
- to transmit, distribute, store or destroy any material in violation of any applicable law or regulation; or in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate their privacy, publicity or other personal rights; or which is defamatory, obscene, threatening, abusive or hateful;
- as an advertising medium for any product, goods, services or any other kind of advertising content;
- to post anything inappropriate or illegal.
You agree that we may use, publish, sub-license, distribute, amend, update, store and make public material posted to any of our forums, and that we shall not be liable for any damage, loss, liability or harm incurred by any person as a result of that person posting to any of our forums.
You also agree to use our forums entirely at your own risk and you indemnify us against any damage, loss, liability or harm incurred or suffered by us if such damage, loss, liability or harm resulted from material you posted to any of our forums.
Please take note that we do not actively monitor postings and discussions on any of our forums or enforce editorial control over any of the material available there, but we do hold the right to monitor postings and discussions and enforce editorial control if needs be.
You agree to waive all moral rights that you may have to any of the material you post in any of our forums.
Subject to the exercise of our discretion, we will consider removing material from our forums if a party requests the removal of the material in writing and reasonably substantiates why the material ought to be removed.
Rest assured that we are committed to freedom of expression and the free flow of ideas and opinions and will only disclose the identity of users of our forums to third parties if such disclosure is authorised by a court order issued by a South African court.
Intellectual property rights
All rights in and to the content of our websites are reserved and retained by us. Users of our websites are not granted any rights in respect of any of the content of our websites.
Website maintenance and downtime
From time to time it may be necessary for use to maintain our websites. Maintenance may temporarily interrupt the provision of our services. The average availability uptime for our Premium Services will not be less than 99% in a year (excluding any network issues that may be experienced by your network service provider).
Scheduled maintenance downtime will be communicated to you via the website (if the downtime is 2 hours or less), and via email to you at least 48 hours prior to the downtime, if that downtime is scheduled to last more than 2 hours. Scheduled maintenance will, where possible, be outside normal South African business hours.
Limiting our liability
Although we try our best to ensure the integrity of our websites we cannot warrant that they will always operate without error or that files, downloads or applications available via our websites will be free of viruses and other nasty computer bugs which could potentially corrupt or affect your computer.
To the greatest extent legally permissible, you agree that we will not be liable for any costs, expenses, losses or damages of any nature whatsoever arising out of or in any way connected with your use of any of our websites.
We do not warrant the accuracy, reliability, completeness or timeliness of the material, services, software, text, and graphics set out on our websites. Where our websites contain links to any other internet websites, you acknowledge that we do not have control over any such websites and cannot be responsible for what happens if you access any external website through a link we may have provided.
Capping our liability where we can't exclude it
If you have a damages claim against us or one of our affiliates (being any of our subsidiaries, affiliated companies, suppliers, employees, shareholders, or directors), we will under no circumstances be liable to you for a cumulative sum in excess of five times the most recent monthly fee you paid to us (if you subscribe for a Premium Service) or R250, whichever is the greater. This liability cap is an essential part of our agreement with you and without it the terms and conditions on the basis of which we have contracted with you would be substantially different.
Disclaimers in respect of specific websites
CareerJunction, FinJunction, iTalent and PartTimeJobs carry job advertisements and resumés posted by our users. We are not involved in the recruitment process and must not be considered to be recruiters or employers with respect to these services. We are not responsible for any of our users entering into agreements or relying on any information contained in any of these posts. Additionally, we shall not be obliged to give any reasons for the withdrawal of a post by a job seeker or employee from any database, nor shall we be liable for any damages relating to the availability or suitability of the job seeker for any position at which they are placed.
MobiHire carry job advertisements and applications posted by our users. MobiHire uses a combination of web based advertising for Recruiter tools, USSD based tools for seeker application and SMS technology for recruiter to seeker communications. We are not involved in the recruitment process and must not be considered to be recruiters or employers with respect to these services. We are not responsible for any of our users entering into agreements or relying on any information contained in any of these posts. Additionally, we shall not be obliged to give any reasons for the withdrawal of a post by a job seeker or employee from any database, nor shall we be liable for any damages relating to the availability or suitability of the job seeker for any position at which they are placed.
AutoJunction carries auto advertisements, news, reviews and other content independently published by third parties. We are not involved in the buying, selling, manufacturing or repair of motor cars and must not be considered to be a dealer, buyer, manufacturer or repairer. We are not responsible for any user entering into agreements or making decisions of whatever nature relying on information contained in auto advertisements, auto information, the use of financial calculators or any other information obtained from the AutoJunction website.
PropertyJunction carries property advertisements, news, reviews and other content independently published by third parties on the website. We are not involved in the buying, selling or development of properties and must not be considered to be an agent, buyer or a developer with respect to the use of the PropertyJunction website. We shall not be responsible for any user entering into agreements or making decisions of whatever nature in connection with the posting of property advertisements, property information, the use of financial calculators, or any other information obtained on the PropertyJunction website.
Paying for a Premium Service
For those of you who will be signing up for one of the services we offer for a fee (a “Premium Service”), please pay particular attention to this section.
The specific payment terms applicable to you will depend on the option you choose when you subscribe for a Premium Service. Any information you supply to us and any option, package, or plan you select during the registration process forms part of your agreement with us.
If you purchase any Premium Services, you agree to us storing your payment information. You also agree to pay all applicable fees and all related taxes as they become due, and to reimburse us for all collection costs we may incur recovering overdue payments (on an attorney-own-client scale) as well as interest on any overdue amounts, tracing agents' charges and commission.
Please note that a failure to pay your Premium Service fee on time may result in the suspension or termination of your Premium Service.
If the payment method you selected during the registration process reaches its expiration date, and you do not edit your payment method information or cancel your subscription, you authorize us to continue billing you as is and you agree that you will remain responsible for all fees which accrue after your payment method authorisation expires.
The sending of an SMS, via the various recruitment tools, to Seekers are included as part of the definition of “Premium Service”. MobiHire supports the sending of an SMS and includes 2 SMS as part of the initial contract offering. Any additional SMS over and above the 2 included will be charged at additional agreed rates.
You agree to accept the electronic submission of invoices including tax invoices.
Cancelling or suspending a Premium Service
Please note that early termination of your Premium Service may result in a cancellation fee or the loss any discounts you may have been entitled to in a particular service period. Termination of your Premium Service will mean you are downgraded to our standard service.
Additional terms applicable to Recruiters
Anyone accessing any of our websites or using any of our services for the purpose of finding a candidate for a job vacancy is asked to pay particular attention to this section. For the avoidance of doubt, the service regulated in terms of this section is a Premium Service.
Whenever we refer to 'you' in this section we mean you in your role as a Recruiter. A Recruiter is someone who makes use of the online toolset we provide for job profiling, job advertisement media placement and job application response management (what we will call, for the purposes of this section, “the Service”).
With the exception of your own resumé database (if you have one), the copyright and all other intellectual property rights in the Service, including any improvements and modifications, belong to us.
For the purpose of this section we will call a resumé that has been viewed (opened so that you may view the full details of the resumé), forwarded (to your default email address) or downloaded (saved onto your system) within a 24 hour period, a “Clicked Resumé”. We reserve the right to regulate the use of Clicked Resumés.
Our regulation of Clicked Resumés is aimed at ensuring that all our users have fair and equal use of the Service, and that the integrity of the Service is protected against improper use. By 'improper use' we mean:
- supplying, selling, copying or licensing material from our database to any other person (including another member of your group of companies if applicable);
- downloading, searching or viewing our database through any automated (e.g. “scraping”) process;
- contacting any of the individuals on our database or making or allowing any information about those individuals to be used for a purpose other than for finding a suitable candidate for a specific job vacancy.
You are alerted to your obligations in respect of accessing and using personal information (as set out in the Protection of Personal Information Act, 2013). Please note, you indemnify us against any damage, loss, liability or harm incurred or suffered by us as a result of accessing or using any personal information obtained from the use of our Service in breach of your statutory obligations.
The pricing for the provision of the Service, the service period, and your usage allowances for the number of Clicked Resumés in that service period will be set out in the Pricing Proposal you accept when you subscribe for this service.
Just so you're clear on how we keep track of things, a single Clicked Resumé unit is counted for any number of resumé interactions (including viewing, forwarding, downloading and contacting) within a 24 hour period. A counter will show the number of remaining Clicked Resumés units remaining in any particular service period. We will send an email alert to you when only 10% of your units remain. For an additional fee you can top up your units during a service period. Please note that you will not be able to claim a refund for any units which remain unused at the end of the service period.
In the event that you do not make use of or access the Service for a consecutive period of 3 months, your company logo and branding (provided to us on registration) shall be removed from our company listing page. Your branding will be relisted if you re-access the service during what remains of your service period.
If you want to make any changes to the service you've subscribed for you please Contact Us with your request. We cannot guarantee that we will be able to accept your request but we will do our best to accommodate you.
Get hold of us
This Agreement together with any information you supply to us and any option, package, or plan you select during any registration process with us, represents the entire agreement between you, the user, and us in relation to your use of our websites and services.
Nothing in relation to your use of our websites shall constitute a partnership or a joint venture between us, nor will authorise either of us to incur any liability on behalf of the other.
You agree to the South African District Magistrates' Court having jurisdiction over anything arising out of this Agreement, notwithstanding that the amount of the matter in dispute may exceed the Magistrates' Court jurisdiction. Notwithstanding the above, we will be entitled to institute proceedings against you in the South African High Court.
